Resolving Commercial Property Disputes
Various avenues are available to resolve commercial property disputes before legal action becomes necessary, including negotiation, mediation, and arbitration. However, whichever route we take, we always focus on maintaining good communication. Constructive discussion is beneficial in resolving disputes and maintaining your relationship with the other party, which is often crucial.
Be prepared
Disputes often arise unexpectedly. So, while it may sound cynical, always keep a written record of any dealings with the other party, even if there is currently no dispute. Follow-up letters or emails after meetings and telephone conversations can ensure no misunderstanding between you and serve as a helpful reference should a dispute arise.
In addition, maintaining a log of any incidents relevant to a current or possible future dispute is invaluable. Remember to note the date, time, and location of any incident. Record as much information as possible – and as soon as possible – always noting the date and time you made the note.
